Tabi Pty Ltd ACN 147 969 471 (“Tabi”, “Tabi Products”, “we”, “us”, and “our”)
Orders for Tabi products can be made online through this website ("Site"). Each order is made subject to and conditional upon acceptance of these Terms of Sale.
The final details of your order will be set out on the "Check Out" page of this Site prior to proceeding to the "Payments" pages (which are provided by a secure link to an eCommerce platform such as Shopify, and/or a payment service provider, such as PayPal). After the authorisation of your debit card, credit card or PayPal payment, we will send you an email confirming receipt of your order detailing the products you have ordered together with an order number. This email is not an order confirmation or order acceptance from Tabi. Tabi reserves the right to refuse any cancel any order for any reason. Tabi is not obliged to fulfil any order unless the order is accepted by Tabi.
For example, Tabi may, in its sole discretion, limit or cancel quantities purchased per person, per household, per corporation or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event we make a change to or cancel an order, we will attempt to notify you by contacting the email, billing address or telephone number provided at the time the order was made, as Tabi considers best. Tabi reserves the right to limit or prohibit orders that, in Tabi's sole discretion, appear to be placed by dealers, resellers or distributors.
An order is deemed to have been accepted by Tabi, and then cannot be changed or cancelled, only when Tabi ships the product ordered.
Changes, Errors and Cancellations
It is your responsibility to inform Tabi immediately of any errors in your order. If you'd like to cancel or change your order, please contact us as soon as possible. We'll do everything we can to accommodate your request but please bear in mind that our order fulfilment and shipping systems are designed to get orders on their way quickly and efficiently and an order may have already been despatched prior to you notifying us of a change, error or cancellation. Tabi cannot change or cancel an order once it has been despatched.
If you cancel or change an order for a product that qualified you for a discount, promotion or special deal, you may no longer receive that discount, promotion or special deal.
Subject to you accepting the “Cautions” section below, Tabi warrants to you, the original purchaser, that the product will be supplied free from defects in materials and workmanship. If on arrival you believe there is any fault in workmanship or materials in connection with the product you must return it to Tabi within 21 days, together with proof of your purchase. If, on inspection by us, the product is found to be defective in materials or workmanship and has been returned within 21 days from the date of purchase, Tabi will, at its option, repair or replace the product with the same or a similar product to the same value as the original without charge, or pay the cost of having the product repaired. This warranty will not apply to defects in the product caused by accidental damage, abuse, misuse, improper care, alteration or the natural breakdown of product, comparable to the natural breakdown of similar products or products made from similar materials.
Tabi's liability for any cause in respect of the supply of products is limited to the payments made by you to Tabi for the product.
To the full extent permitted by law and except as imposed by the Australian Trade Practices Act 1974 and/or any equivalent local statute, all other warranties (express or implied and arising by virtue of statute or otherwise) and all other liability, including for physical or financial consequential loss or damage (including loss of profit) and whether arising from negligence or otherwise are excluded.
Unless expressly stated, our products are not toys and should be kept away from children. Keep our products away from heat and direct sunlight. Do not position your tablet or other device in or on one of our products in such a way that it may fall off the product. Before using our products, gently test that your tablet or other device fits our products and determine the suitability and common sense limits of their use. For any surface on which you place one of our products, test that our products are stable on this surface. If using our products on your body, such as on your chest when reading, keep one hand on your tablet and do not position our products where your tablet or device may fall of the product. Take special care not to allow your tablet to fall toward your face.
The price that you pay for the product will be the price that is displayed on the Site at the "Check Out" stage of the purchasing process.
Although we are an Australian company, for logistical purposes our products may be warehoused in the USA, in Hong Kong, the UK or other location and may ship to you from one of these locations. At time of writing, our products are warehoused and delivered by the fulfilment and logistics service Shipwire.com. The cost of shipment is calculated automatically by this service.
Any discounts Tabi offers are time limited and are subject to product availability. The price of such products may change from time to time and changes in price will be available on the Site.
We will take payment from your debit or credit card, or through Paypal, after you have authorised the payment by confirming the "Check Out" stage of the order. If we are unable to supply the product that you have ordered, we will attempt to contact you by telephone or email to offer you either a full refund or a substitute product. If we do not receive a response from you within 24 hours of our first attempt to contact you, we will refund the total amount we deducted from your debit or credit card as expediently as possible within the normal course of our business operations.
We will endeavour to ensure that all prices on our Site are accurate. However, from time to time pricing errors may occur. If an error is found in the price of the product you have ordered, we will contact you as soon as possible. If a product’s correct price is lower than the price stated on our Site, we will charge the lower amount to your debit or credit card and send the product to you. If a product’s correct price is higher than our stated price, then we will give you the option of either continuing with your purchase at the correct price or canceling the order affected by the error. We will deem the order to be cancelled if we do not receive a response from you within 24 hours of our first attempt to contact you. In such a case, we will refund the total amount we deducted from your debit or credit card.
Tabi or a fulfilment service such as Shipwire.com will endeavour to dispatch products to you promptly following receipt of your order, unless cancelled for any reason prior to shipment. The delivery options available to you will display automatically on our site.
Delivery is deemed to have been made, and title and risk is transferred to you, when Tabi or a fulfilment service nominated by us delivers the products to its carrier.
Pay close attention to your options at checkout. Depending on your selections, your order may be sent via airmail to the country of destination at which point its delivery may be reliant on local postal services. International airmail orders are not insured nor traceable and Tabi cannot be held liable for loss or damage in transit.
Unless otherwise expressly agreed in writing, any delivery date or time specified by us in any quotation, despatch note or otherwise, is a best estimate only and we will not be liable to you for any loss or damage sustained by you if we fail to meet that delivery date or time.
For deliveries outside of Australia, you may be required to pay import duty, customs charges or other local taxes. Customs policies vary widely from country to country so please contact your local customs office for further information. Please note that the payment of any import duties, customs charges, local taxes or any administration charges paid to couriers in relation to these fees, is your responsibility. Tabi is not responsible for the payment of any of the abovementioned charges.
If you are not completely satisfied with your purchase, you may return a product within 7 days of receipt for replacement or refund of the product price. Return shipping will be at your expense. After 7 days, Tabi will not accept returns for any reason other than defects. Refunds must be accompanied by the original receipt and will be made in the form of the original payment.
To return an item:
Pack your return product in the original packaging and shipping box. Include a copy of your invoice complete with your reason for return. When you contact us regarding the return, we or our nominate fulfilment service will provide you with a shipping label you must use in order to ensure the product returns to the correct warehouse.
If you purchased your product at a retail location, please return it to the place you originally purchased it from.
